Sweepstakes Period: The Land of Nod Holly Jolly Pinterest Contest (the “Sweepstakes”) runs from 12:00 AM Central Time (“CT”) November 4, 2015 through 11:59 PM CT November 11, 2015 (the “Sweepstakes Period”). The Sponsor’s computer timeclock is the official timekeeper for all Sweepstakes purposes. Evidence of sending an entry is not evidence that Sponsor received the entry, and Sponsor’s computer records prevail in any such dispute.
Sponsor: Meadowbrook L.L.C., an Illinois corporation, d/b/a The Land of Nod (“The Land of Nod” or “Sponsor”), with headquarters located at 8135 River Dr., Morton Grove, IL 60053.
Eligibility: The Sweepstakes is open only to legal residents of the United States who are the age of majority or older in their state or jurisdiction of residence at the time of entry (excluding Guam, Puerto Rico, the U.S. Virgin Islands). Entrants must have pre-existing Internet access and an email account in order to enter the Sweepstakes and must be opted-in to receive email messages from The Land of Nod at the time of the random prize drawing in order to win. Employees of Sponsor, ExactTarget, Pinterest or of any of their respective parent companies, affiliates, agents, or advertising and promotion agencies (collectively, the “Sweepstakes Entities”), and any such employee’s immediate family members (spouse, children, parents and siblings) and those living in the same household of each such employee (whether or not related) are not eligible to enter the Sweepstakes. Void in Guam, Puerto Rico, the U.S. Virgin Islands and where prohibited by law.
How to Enter:
PRIMARY ENTRY
Entrant must have a valid Pinterest page at the time of entry. Entrants may enter the Sweepstakes by visiting https://gleam.io/wZ9k8/holly-jolly-pinterest-contest (the “Website”), where entrants will be provided a link to The Land of Nod’s Holly Jolly Pinterest Contest Board and access to the official entry form. Each entrant must fill out and submit an official entry form and select images from The Land of Nod’s Holly Jolly Pinterest Board to pin to his or her own Pinterest board or pin any image of his or her choice and submit the url of his or her Pinterest Board with the official entry form. Only one Primary Entry per person. Use of multiple email addresses or Pinterest accounts by the same individual to enter is prohibited and such multiple entries shall be voided. Entries submitted by automated methods are prohibited.
Entrants agree that they will only pin images that are appropriate for the intended audience, comply with the Pinterest content rules, and do not conflict with, or otherwise infringe, the rights of a third party, all in Sponsor’s sole discretion. Please note that a Pinterest membership is not controlled by and cannot be guaranteed by Sponsor. Pinterest accounts must be public and must not be set to “secret” in order for Sponsor to verify compliance with the Official Rules.
Entrants also agree to disclose that any The Land of Nod pins posted to an entrant’s Pinterest Board in connection with the Sweepstakes is disclosed as associated with this Sweepstakes.
Additional Entries
Entrants also may receive additional entries by partaking in the following actions on the Gleam Contest Page: Following The Land of Nod on Pinterest, subscribing to The Land of Nod’s blog RSS feed, following The Land of Nod on Instagram, retweeting a tweet by The Land of Nod’s Twitter account, or subscribing to The Land of Nod’s YouTube channel.
Entrants also agree to disclose that any social media posts or mentions initiated by entrants in connection with the additional entries, including but not limited to re-tweets, must include a disclosure that the mention is associated with this promotion, such as “#sweeps.”
By entering, entrants agree to receive marketing emails from The Land of Nod.
GRAND Prize and Approximate Retail Value: One (1) Grand Prize is available to be won. The Grand Prize winner (the “Grand Prize Winner”) will receive a The Land of Nod gift card worth $2,500. Total ARV of the Grand Prize is $2,500.
In no event will Sponsor be obligated to award more than the Grand Prize. No cash substitution or transfer of prize is permitted, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute any portion of the Grand Prize with a prize of equal or greater value for any reason, including due to prize unavailability or due to circumstances beyond Sponsor’s control. Prize limitations may apply, as stated on or in connection with the prize itself.
Prize and value for prize is in US dollars. All taxes are the sole responsibility of the winner; Sponsor is not responsible for any taxes or expenses that winner may incur as a result of the Sweepstakes or receipt of any prize. Sponsor will provide potential prize winner a Federal W-9 tax form which must be completed prior to receiving the prize. Sponsor will report the prize to the applicable authorities and provide the winner with a 1099 Tax Form.
Random Drawings: One potential (1) Grand Prize winner will be selected from among all combined eligible entries in a random drawing conducted on or about November 12, 2015 by Sponsor whose decisions are final and binding in all aspects regarding this drawing.
The odds of winning prize will depend on the number of eligible entries received for the Sweepstakes during the Sweepstakes Period.
Potential Grand Prize winner will be notified via the email address provided in the entry on or about November 12, 2015. Return of any prize notification email as non-deliverable will result in disqualification and an alternate winner may be randomly selected. A Declaration of Eligibility and Publicity/Liability Release will be attached to the notification email, which, where applicable and permitted by law, must be completed and returned to the address provided and received within 120 hours after the notification attempt. Potential Grand Prize winner also will receive a W-9 tax form which must be completed and returned to the address provided and received within 120 hours after the notification attempt.
Should any potential Grand Prize winner’s completed Affidavit of Eligibility and Publicity/Liability Release, where applicable, for whatever reason, not be returned within 120 hours, or should any potential Grand Prize winner otherwise fail to comply with the Official Rules, the Grand Prize may be awarded to an alternate winner selected from among all remaining eligible entries. Any alternate potential Grand Prize winner will be selected in the same manner, with the same requirements and within similar time frames as for the original potential Grand Prize winner.
Miscellaneous Terms: This Sweepstakes is subject to all applicable federal, state and municipal laws and regulations. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor, which are final in all respects, and agree to receive marketing emails from Sponsor. By accepting a prize, confirmed winner further agrees: (1) that Sponsor may (unless prohibited by law) use winner’s name, comments, city of residence, photograph, image and/or likeness for advertising and/or other promotional purposes without further review or compensation in any media, in perpetuity and worldwide, and, where applicable, entrant waives his/her moral rights therein, unless prohibited by law (2) to release and hold harmless Sponsor, Pinterest, Instagram, Twitter, and YouTube, along with their affiliates, advertising and promotions agencies, prize suppliers and any other agency that provides services in connection with this Sweepstakes, (collectively, the “Released Parties”) from and against any and all rights, claims and causes of action whatsoever that he/she may have, or which may arise, for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to any person, including death or property damage, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize in the Sweepstakes, or their participation in the Sweepstakes, or their participation in any Sweepstakes-related or prize-related activity. Grand Prize Winner also further acknowledges that the Released Parties have neither made, nor are in any manner responsible or liable for, any warranty, representation, condition or guarantee, expressed or implied, in fact or in law, relative to any prize or the Sweepstakes itself.
Sponsor is not responsible for incomplete, lost, late, damaged, illegible, misplaced or misdirected entries or faulty transmissions, technical computer hardware or software failures of any kind, lost or interrupted or unavailable network connections, or failed, incomplete, garbled, misrouted, scrambled or delayed computer transmission, or other errors or problems of any kind, whether mechanical, human, electronic or otherwise, that may limit a user’s ability to participate in the Sweepstakes. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prizes. Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Sweepstakes; (d) inaccessibility or unavailability of the Internet or any website or any combination thereof; or (e) any injury or damage to any participant’s or to any other person’s computer or other property that may be related to or resulting from any attempt to participate in the Sweepstakes or download any materials in the Sweepstakes.
Sponsor reserves the right to (1) disqualify any entrant and void any entries of an entrant who has engaged in unsportsmanlike conduct, fraud or other misconduct relative to this Sweepstakes, has acted in a manner Sponsor deems to be disruptive or in violation of the Official Rules, has acted with intent to annoy, abuse, threaten or harass any other person, or otherwise has attempted to tamper with or impair the Sweepstakes, including by registering via multiple email addresses, and (2) to cancel, modify, suspend or terminate the Sweepstakes if, in Sponsor’s sole opinion, technical failures, applicable laws or regulations, viruses, bugs, unauthorized human intervention or any other cause beyond Sponsor’s control disrupts the integrity of the Sweepstakes or otherwise corrupts or impairs the administration, security, legality, fairness or proper play of the Sweepstakes or any part thereof.
If, for any reason, the Sweepstakes is not capable of running as planned for reasons that may include without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, violation of applicable law or regulation or any other causes that may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part.
In the event of a dispute regarding who submitted an entry, the entry will be deemed to have been submitted by the authorized account holder of the email address submitted on the entry form at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet service provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Winner’s Identification: The name and city/town of residence of Grand Prize Winner can be obtained by sending a written request to Sponsor. Written requests must be received by Sponsor between November 17, 2015 and March 31, 2016 (the “Request Period”) and must include a self-addressed, stamped envelope bearing sufficient postage. Requests must be sent to: The Land of Nod, Attn: The Land of Nod Holly Jolly Pinterest Contest Winner Identification, 8135 River Dr., Morton Grove, IL 60053, along with a written request for such information. Such requests will be honored only if received during the Request Period; requests received after the last day of the Request Period will not be honored.

PRIVACY: By entering the Sweepstakes, each entrant consents to the use of his/her personal information by the Sponsor or its agents or representatives for the purpose of administering the Sweepstakes, including for use in a winners list, sending marketing materials and otherwise as permitted or required by law. Your personal information will be treated in accordance with Sponsor’s Privacy Policy, available at www.landofnod.com/Customer-Service/Privacy-Policy.aspx.
DISPUTES: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the state of Illinois. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the state of Illinois, without giving effect to any choice of law or conflict of law rules that would cause the application of the laws of any jurisdiction other than the state of Illinois.
